The appellee was indicted again by the 1977 grand jury for the same four counts of perjury, plus one count of official misconduct. A different district court judge granted appellees motion to dismiss the second indictment for lack of probable cause, this time because the district attorney had not presented two witnesses before the grand jury, as required by Crim. P. 6(b). No appeal was taken from this dismissal.
